COVID-19 Heroes Deserve our Protection
Pennsylvania’s health care providers and businesses large and small are incurring risk to provide life-saving care, equipment and goods to get us all through the COVID-19 public health crisis. Businesses are struggling to stay afloat and now face lawsuits when they re-open. They deserve our gratitude and support. They also deserve our protection.
Front-line heroes aren’t only at risk for contracting the COVID-19 virus. They also face the unprecedented threat of liability from “Billboard Lawyers” looking to take advantage of the crisis. While stores, offices, restaurants , plants, and health care providers are rising to the challenge of defeating this virus, trial lawyers are looking to cash in!
The Plaintiffs’ bar is already seeking clients interested in pursuing product liability class actions, and other civil and criminal liability claims related to coronavirus treatment, care and exposure. Even as businesses try to help individuals survive the COVID-19 pandemic, they may unwittingly expose themselves to crippling lawsuits. Pennsylvania already has one of the highest unemployment rates in the United States as the result of the COVID pandemic. Lawsuits will only hinder and delay Pennsylvania’s economic recovery.
Pennsylvania’s Legislature Must Act Now!
Senate Bill 1239 provides liability protection for healthcare practitioners and providers, personal protective equipment manufacturers, and shields businesses, schools, and non-profits from lawsuits alleging exposure to COVID-19, as long as applicable government guidelines for safety are being followed. This bill is a targeted, temporary, but necessary response to the threat of litigation from lawyers looking to cash in on the COVID-19 pandemic!
Liability protections create incentives for private and nonprofit entities to join with government agencies to prepare for and respond to public health emergencies. Many states are enacting laws to protect COVID-19 heroes from lawsuits, but Pennsylvania has not.
Time is running out for the legislature to pass SB 1239 or similar legislation to protect our frontline heroes and promote Pennsylvania’s economic recovery. Your state Senator and Representative need to hear from you today!
